This weekend, Lally Immigration Services, LLC filed a Religious Worker Petition on behalf of a Minister.
Ministers and non-ministers in religious vocations and occupations may immigrate to or adjust status (i.e., apply for a “green card”) in the U.S. for the purpose of performing religious work in a full-time compensated position.
Generally, a U.S. employer files a Religious Worker petition on behalf of an individual who seeks to enter the United States to be employed full-time by a bona fide nonprofit religious organization in the United States (or a bona fide organization that is affiliated with the religious denomination in the United States) to work:
1. Solely as a minister of that religious denomination;
2. In a religious vocation either in a professional or non-professional capacity; or
3. In a religious occupation either in a professional or non-professional capacity.
A Religious Worker may, however, file this petition on his or her own behalf.
To qualify, the Religious Worker must have been:
1. A member of a religious denomination that has a bona fide nonprofit religious organization in the United States for at least the two years immediately preceding the filing of the petition; and
2. Working continuously, after turning 14 years of age, in one of the positions described above, either abroad or in the United States, for at least two years immediately preceding the filing of the petition.

As of March 9, 2021, applicants should NOT file Form I-944, Declaration of Self-Sufficiency, or any evidence or documentation required on that form with their Form I-485.
The Form I-944 has been discontinued.
