Last month, Lally Immigration Services, LLC was retained to prepare a response to a Notice of Continuance issued on a N400 military naturalization application.
— What is a Notice of Continuance? —
A Notice of Continuance is a written request from the USCIS for additional information or documentation.
A Notice of Continue should include:
1) The specific information or documentation that the officer is requesting;
2) The ways in which the applicant may respond; and
3) The period of time that the applicant has to reply.
— What Did The Notice of Continuance Say? —
In the Notice of Continuance, the USCIS accused the naturalization applicant of marrying someone solely for an immigration benefit and thereby failing to establish good moral character.
— How Did We Respond? —
Lally Immigration Services responded to the Notice of Continuance with the documentation requested by the USCIS as well as detailed explanation of how this applicant was eligible for naturalization through military service, as a person who is honorably serving our country in this designated period of armed conflict.
Further, Lally Immigration Services argued that Applicant’s good moral character most certainly ” … measures up to the standards of average citizens of the community in which the applicant resides” as well as the standards of average citizens across the nation, for whom this applicant has pledged their life to protect.
— Outcome? —
