What the New H-1B Proclamation Really Means

On September 21, 2025, the USCIS issued a news release (here) regarding the new Presidential Proclamation which introduces a $100,000 “add-on” payment for all new H-1B petitions filed after 12:01 a.m. EDT on September 21, 2025.

But here’s what’s most important: it does not affect any H-1B petition already filed or currently pending.

Key Takeaways

  • No impact on pending cases: If your petition was filed before Sept. 21, 2025, it is not subject to the new fee.

  • No impact on renewals or extensions: The $100,000 payment applies only to new petitions, not H-1B extensions.

  • No impact on current H-1B visa holders: Existing visas remain valid, and travel rights are unchanged.

Bottom Line

The Proclamation is a major change for future H-1B filings, but it does not jeopardize cases already in process.
