June 30th, 2023 | immigrationworkingvisa

Under the International Entrepreneur Rule (IER), the Department of Homeland Security has the power to grant noncitizen entrepreneurs a period of authorized stay in the U.S. This occurs on a case-by-case basis and entrepreneurs must show that their stay in the United States would provide a significant public benefit through their business venture and that they merit a favorable exercise of discretion.

Immigration Timelines

May 19th, 2023 | immigrationworkingvisa

Immigration processes can be time-consuming, so it is advisable to start your visa application well in advance of your intended travel date. Some visa categories have limited quotas or waiting periods, and the processing times can vary. By planning ahead, you can avoid unnecessary delays and ensure you have ample time to complete all the necessary steps. If you have any questions on immigration timelines, book a consultation with me directly on my website (link in bio).

Priority Dates

February 22nd, 2023 | immigrationworkingvisa

What are priority dates?
.
Priority dates are used to determine an immigrant’s place in the visa queue. When the priority date becomes available or is “current,” immigrants may be able to apply for adjustment of status and obtain lawful permanent resident status, if otherwise eligible.
.
An immigrant visa is available to an immigrant when their priority date is earlier than the cut-off date shown for their preference category and country of changeability in the applicable chart in the Visa Bulletin.

What is Visa Retrogression?

November 16th, 2022 | immigrationworkingvisa

Visa retrogression occurs when more people apply for a visa in a particular category than there are visas available for that month. In these circumstances, the cut-off date on the Visa Bulletin moves backward to an earlier date.
