What is a Derivative Beneficiary?

A derivative beneficiary is a foreign national who cannot be directly petitioned for, but who can follow-to-join or accompany the principal beneficiary based on a spousal or parent-child relationship.

When a derivative beneficiary of a family-sponsored preference petition (such as F4) reaches the age of 21, they are no longer considered a “child” for immigration purposes. Instead, they are classified as an “adult” or “aged-out” child.

Congress recognized that many children were aging out due to large USCIS processing backlogs, so it enacted the Child Status Protection Act (“CSPA”) in August 2022 to protect certain children from “aging out.”

Recently, an interviewing officer at the USCIS Boston Field Office posed some unexpectedly detailed questions to assess the genuineness of my client’s relationships.

Who sleeps closer to the door?

These seemingly simple questions can test your knowledge of everyday details in your shared life. While they might seem trivial, they play a role in assessing the depth of your relationship. The officer’s line of questioning highlights the importance of being prepared for anything during the interview.

As of August 19, 2024, USCIS is now accepting requests using the new electronic Form I-131F, Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens.

Please remember, USCIS will only accept Form I-131F for this process. If you need to keep your family together, make sure you’re using the correct form and not any other for Parole in Place.
