Proclamation on the Suspension of Entry as Immigrants and Non-Immigrants of Certain Additional Persons Who Pose a Risk of Transmitting Coronavirus Disease

On January 25, 2021, President Biden issued a Proclamation on the Suspension of Entry as Immigrants and Non-Immigrants of Certain Additional Persons Who Pose a Risk of Transmitting Coronavirus Disease.[ii]

The Proclamation suspends the entry into the United States, as immigrants or nonimmigrants, those who were physically present in the following regions during the 14-day period preceding entry or attempted entry into the United States:

  • The Schengen Area;
  • The United Kingdom (excluding overseas territories outside of Europe);
  • The Republic of Ireland;
  • The Federative Republic of Brazil; and/or
  • The Republic of South Africa.[iii]

This suspension and limitation on entry does not apply to (among others):

  • Citizens of the United States;
  • Lawful permanent residents of the United States; and
  • Spouses of U.S. citizens or lawful permanent residents.[iv]

The Proclamation was placed into effect at 12:01 am EST on January 26, 2021.[v] The Secretary of Health and Human Services will recommend whether the President should continue, modify, or terminate the proclamation within 30 days.[vi]
