USCIS ENDS Extended Deadline Flexibilities for RFEs, NOIDs, NOIRs, etc.

USCIS ENDS Extended Deadline Flexibilities for RFEs, NOIDs, NOIRs, etc.

This afternoon, the USCIS announced an end to the deadline flexibilities that it first initiated in March 2020 in response to the COVID-19 pandemic. 

For years, the USCIS has considered a response received within 60 calendar days after the due date set forth in an official USCIS request or notice before taking any action. 

As of March 23, 2023, that is no longer the case.

Starting today, individuals must respond to any notice or request from the USCIS dated after March 23, 2023 by the deadline listed in the notice or request. This includes:

  • Requests for Evidence;
  • Continuations to Request Evidence (N-14);
  • Notices of Intent to Deny;
  • Notices of Intent to Revoke;
  • Notices of Intent to Rescind;
  • Notices of Intent to Terminate regional centers;
  • Notices of Intent to Withdraw Temporary Protected Status; and
  • Motions to Reopen an N-400 Pursuant to 8 CFR 335.5, Receipt of Derogatory Information After Grant.
