New USCIS Policy: Extended Green Card Validity for Renewals

On September 10, 2024, the U.S. Citizenship and Immigration Services (“USCIS”) implemented an important change for lawful permanent residents: the automatic extension of Permanent Resident Cards, commonly known as Green Cards.

This new policy significantly benefits those who file Form I-90, Application to Replace Permanent Resident Card, as it extends the validity of the Green Card to 36 months for individuals who are renewing an expiring or expired card.

Key Changes to the Renewal Process

Under the previous policy, Green Card holders received a 24-month extension upon filing Form I-90. However, with the updated guidelines, receipt notices will now indicate a 36-month extension from the expiration date listed on the current Green Card. This change reflects USCIS’ recognition of the longer processing times many applicants have faced in recent years.

Starting September 10, USCIS began issuing amended receipt notices for those who have a pending Form I-90 application. These new notices can be presented alongside an expired Green Card, serving as valid proof of lawful permanent resident status and employment authorization during the waiting period for the renewed card.

What If You Don’t Have Your Green Card?

If you find yourself without your Green Card while awaiting a replacement, don’t worry. You can request an appointment at a USCIS Field Office by contacting the USCIS Contact Center. After you file Form I-90, you may be issued an Alien Documentation, Identification, and Telecommunications (“ADIT”) stamp, which will also serve as evidence of your status.

Keeping Your Information Updated

As always, it’s crucial to keep your information current. If your mailing address changes while your Form I-90 application is pending, be sure to update your address through your USCIS Online Account if you have one. This helps ensure that you receive all important correspondence regarding your application in a timely manner.
