What is EB2 NIW?

Employment-Based (second preference category) National Interest Waiver.

Generally, foreign professionals holding advanced degrees or foreign nationals of exceptional ability must have a valid job offer from a U.S. employer and that employer must complete an extensive labor certification process before moving forward with the immigrant visa process.

The USCIS may, however, waive the job offer and labor certification requirements if doing so is in the interest of the United States government.

National interest waivers are usually granted to those who have exceptional ability and whose employment in the United States would greatly benefit the nation.

EB2 NIW Requirements 

Like all EB-2 workers, a person seeking a national interest waiver must first qualify as either an advanced-degree professional or an alien of exception ability, i.e., one whose expertise significantly rises above that ordinarily encountered.  

Additionally, applicants seeking a national interest waiver must satisfy the three (3) criteria below:

  • The proposed endeavor has both substantial merit and national importance;
  • The applicant is well positioned to advance the proposed endeavor; and
  • It would be beneficial to the United States to waive the requirements of a job offer, and thus the labor certification.

What is Conditional Permanent Residency?

TRUE! Two-year green cards are given to individuals who were married less than two years at the time they obtained their green card. This is known as “conditional permanent residency.”

In order to remain a permanent resident, a conditional permanent resident must file a petition to remove the conditions of their residency during the ninety days before their two-year green card expires.
