Marriage-Based Green Card Interview Waived 2023 – Couple Living in Separate States!!

 

This week, I had a marriage-based green card interview waived for a married couple living in separate states! 

 

Marriage Green Card Timeline

 

  • 05/11/2023 – Submitted
  • 05/12/2023 – Receipt Notices
  • 06/06/2023 – Biometrics Scheduled
  • 06/07/2023 – RFE for Sealed Medical
  • 10/16/2023 – IV & GC Approved
  • 10/18/2023 – Green Card Produced
  • 10/19/2023 – Green Card Delivered

 

Can I be married but living separate and apply for a green card?

Yes! Lots of people are hesitant to file a marriage-based green card if they are currently living apart from their spouse. 

 

So long as there is a legitimate basis for the decision to live apart, this factor alone, should not impact your eligibility for a marriage-based green card.

 

How do you prove a bona fide marriage without living together?

 

There are several ways to prove a bona fide marriage if you are not currently living together. Please keep in mind that joint tenancy is only one of the factors that the USCIS considers when making a determination as to whether a “bona fide” marriage exists. To prove a bona fide marriage without living together, you should submit as many of the following other types of documents as possible: affidavits of relationship, evidence of joint children, evidence of joint finances, evidence of joint travel, 15-20 photographs (with date – place – description), etc.
