This morning, Attorney Dayna Lally of Lally Immigration Services, LLC attended a marriage based green card interview at the USCIS Boston Field Office.

A marriage-based green card is available for the spouse of a U.S. citizen or lawful permanent resident, i.e., green card holder.

Marriage Based Green Card Process

The marriage based green card process generally entails filing an immigrant visa petition (Form I-130) together with an application for adjustment of status (Form I-485) and applications for employment authorization (Form I-765) and advance parole (Form I-131).

All U.S. citizen spouses are required by law to submit an affidavit of support (Form I-864) to show that they can financially support their foreign spouse as well as the rest of their household at 125% of the Federal Poverty Guidelines.

Recently, the USCIS has allowed the immigrant visa portion of the marriage based green card application package to be filed online.

Marriage Based Green Card Timeline

The marriage based green card timeline 2021 in the USCIS Boston Field Office is approximately 6 -7 months; this may vary depending on a variety of factors.

The marriage green card timeline 2020 at the USCIS Boston Field Office was slightly longer. Presumably, due to COVID-19 and USCIS office closures.

Immigration Lawyer Marriage Costs

Immigration fees for green card through marriage vary among attorneys.

Lally Immigration generally charges a flat fee of $2,500 to prepare a marriage-based green card application. This fee can be broken down into four (4) equal installment payments, if requested.

  • $625 – To begin marriage based green card application;
  • $625 – Prior to filing marriage based green card application with USCIS;
  • $625 – When USCIS receipts the marriage based green card application; and
  • $625 – Prior to the mock marriage based green card interview. 

Marriage based green card filing fees currently total $1,760 ($535 + $1,140 + $85). Green card applicants are also required to submit a sealed medical examination. The cost of an immigration medical exam varies by location and by doctor.

What is Conditional Permanent Residency?

TRUE! Two-year green cards are given to individuals who were married less than two years at the time they obtained their green card. This is known as “conditional permanent residency.”
