This afternoon, I have a consultation with an individual who is looking for assistance with a K1 visa application for his fiance.

Before every consultation, I send an email requesting a bulleted list of the questions or concerns that the individual would like to discuss. This sets an agenda for the consultation and facilitates great communication between prospective clients and myself.

Fiance Visa Processing Time 2023

What is the fiance visa processing time for 2023?

My most recent fiance visa petition in 2023 was approved in 1 year and 8 days:

  • 08/22/2022 – Received by California Service Center
  • 08/09/2023 – Approval
  • 10/11/2023 – NVC Received Approval from USCIS

Keep in mind, this processing time is only for the first step of the fiance visa petition (the Form I-129F). The second (Form DS-160) and third (Form I-485) steps follow entirely different timelines.

 

Fiance Visa Requirements

The following evidence must be submitted with a fiance visa petition:

  • Proof of U.S. citizenship;
  • Proof of Termination of Previous Marriages;
  • Passport-Style Photographs (of petitioner and foreign fiance);
  • Proof of Legal Name Change (if any);
  • Proof of Admission to the United States (if any);
  • Proof of Intention to Marry Within 90 Days of Entry;
  • Proof of In-Person Meeting (during 2-year period immediately before filing); and
  • Certified Copies of Petitioner’s Court and Police Records (if applicable).

 

Fiance Form USCIS

A petition for a foreign fiance is submitted to the USCIS on Form I-129F, Petition for Alien Fiancé(e). The filing fee for Form I-129F is $535.

 

Steps for Fiance Visa

The fiance visa is at least a four-step process:

  • Step 1: Fiance Visa Petition 
  • Step 2: Online Nonimmigrant Visa Application 
  • Step 3: Admission to United States > Marriage
  • Step 4: Adjustment of Status

What Happens If You Don’t Get Married on a Fiance Visa?

Foreign fiances are generally given 90 days to marry the U.S. citizen petitioner. If the couple does not marry, the foreign fiance must depart the United States. If the foreign fiance does not depart, they will be in violation of U.S. immigration law, and therefore, subject to removal (deportation).
