Lawsuit Challenging the New USCIS Fee Increase

Lawsuit Challenging the New USCIS Fee Increase

Today, the American Immigration Lawyers Association (“AILA”) announced that it has partnered with the law firm of Sidley Austin, LLP to file a lawsuit seeking an emergency nationwide injunction of the Department of Homeland Security (“DHS”) new Fee Rule, which is set to go into effect on October 2, 2020.[i]

AILA’s Director of Litigation, Jesse Bless, says “USCIS’ dramatic fee increases … place an unlawful barrier in the way of individuals eligible for immigration benefits. …”[ii]

The lawsuit challenges how the USCIS calculated the increased fees (ranging from 30 to 266%) and how it burned through the ample cash reserves it had on hand just a few years ago.[iii]
